As part of the Missouri Department of Conservation (Department) Online Permit System, the Department offers purchasers of permits, the ability to set up regularly-scheduled purchases and deliveries of eligible items by enrolling in the Permit Auto-Renewal Service (Auto-Renewal). For purposes of these terms and conditions, Department shall mean the Missouri Department of Conservation, its contractors and agents, Auto-Renewal shall mean Permit Auto-Renewal Service, user shall mean the customer, and billing shall indicate a charge, debit, or other payment clearance, as applicable, against your Payment Method.

  1. Acceptance of Permit Auto-Renewal Service Terms and Conditions. These terms and conditions govern the use of the Department’s Permit Auto-Renewal Service. By enrolling and participating in Auto-Renewal, the user accepts and agrees to the Auto-Renewal Terms and Conditions. If the user does not agree to the Auto-Renewal Terms and Conditions, the user should not opt into Auto-Renewal.
  2. Changes to Permit Auto-Renewal Service Terms and Conditions. The Department may, update the Permit Auto-Renewal Service Terms and Conditions. Such updates shall be effective immediately and a copy of the updated Terms and Conditions will be emailed to those currently participating in Auto-Renewal.
  3. Privacy. Personal identifying information is subject to the Department’s Internet Use Privacy and Security Policy. Please review the Department’s Internet Use Privacy and Security Policy at https://mdc.mo.gov/privacy-and-security.
  4. Membership, Billing and Cancellation.
    1. Membership
      1. Ongoing Membership. Auto-Renewal membership will be recurring and will automatically renew until the user, or the Department at the request of the user, cancels their Auto-Renewal membership, or if the Department cancels the membership due to the user violating the Permit Auto-Renewal Service Terms and Conditions. The user must have internet access and provide the Department with a current, valid, and accepted method of payment method, which may be updated via the Manage Your Account settings, to be used by Auto-Renewal. The Department will charge the renewal fee(s) to your payment method as defined under the billing cycle section of the Permit Auto-Renewal Service Terms and Conditions. The user is responsible for cancelling their membership, or select permit(s), prior to the renewal periods identified in the billing cycle section to avoid being charged renewal fees for the permits opted into Auto-Renewal.
        1. The Department can remove a permit(s), or cancel a user’s Auto-Renewal membership.
        2. The Department is not able to opt a user into Auto-Renewal or add permits to the list of permits to be renewed
      2. Auto-Renewal Settings. Changes to Auto-Renewal settings may be made by the user online at www.mdc.mo.gov/buypermits. Select the “Manage Your Account” tab, log into the users account, and select “Manage Your Auto-Renewal Settings.” The Department will continue to bill the payment method provided until the user’s membership in the has been cancelled.
    2. Billing
      1. Recurring Billing. By enrolling in Auto-Renewal, and providing or designating a Payment Method, the user authorizes the Department to charge the user the permit fee at the current rate (as established in the Missouri Wildlife Code of Regulations) to the payment method provided. The user acknowledges the amount charged during each renewal period may vary from year-to-year for reasons that may include permit fee changes due to Missouri Wildlife Code of Regulations changes or by changing the permits enrolled in Auto-Renewal. The user authorizes the Department to charge the Payment Method for such varying amounts.
      2. Price Changes. The Department reserves the right to adjust pricing for permits eligible for Auto-Renewal, or any components thereof, in any manner and at any time as it may determine in its sole and absolute discretion. Except as otherwise expressly provided in these terms and conditions, any price changes will take effect as identified in email notifications sent to the user. The Department will provide notice of the price change; however, it is the responsibility of the user to opt out for the permit(s), or the Permit Auto-Renewal service.
      3. Billing Cycle.
        1. Sales Process. If the user elects to enroll in Auto-Renewal during the sales process, the fee(s) for the permits enrolled in the Auto-Renewal, as well as any permits in the online shopping cart that were not eligible for Auto-Renewal, will be charged upon completion of the online sales process. Only products enrolled in Auto-Renewal will be renewed according to the billing schedule identified below, or until the user cancels their membership.
        2. Manage Your Account. If the user elects to enroll in Auto-Renewal using “Manage Your Account,” the fee(s) for the permits enrolled in Auto-Renewal, will be renewed according to the billing schedule identified below, or until the user cancels their membership.
        3. Billing Schedule. The Department will automatically charge the users Payment Method each year for the permits enrolled in Auto-Renewal as follows:

*Permits in this category are required to be effective March 1; therefore, Auto-Renewal will begin the renewal of these permits prior to the expiration of a current permit.

+Permits in this category will be renewed in advance of their respective season as identified above. Refer to season regulations booklet for more information.

4. Changes to Billing Schedule. The Department reserves the right to change the schedule of Auto-Renewal billing as indicated below.

  1. Permit Availability/Season Changes. In the event changes to the availability of a permit, or the timing of a season would change, Auto-Renewal renewal dates will be changed accordingly. An email notification regarding changes to the Permit Auto-Renewal Service Terms and Conditions will be sent to the user.

5. Refunds.

  1. Nonrefundable. Permits issued through Auto-Renewal are nonrefundable. It is the user’s responsibility to ensure their Auto-Renewal membership and settings are representative of their expectations. If a user prefers to cancel their Auto-Renewal membership, or change the permits enrolled, changes must be made no less than five (5) days before the renewal dates identified in the Billing Cycle section of the Permit Auto-Renewal Service Terms and Conditions.
  2. Exceptions. The Department may at any time, and for any reason, provide a refund or other consideration to some or all its Auto-Renewal users, but in no event, shall the Department directly or indirectly charge, collect, or receive for any issued permit an amount less than or in excess of the price stated for such permit in the Wildlife Code of Missouri. The amount and form of a refund, and the decision to provide a refund, is at the Department’s sole and absolute discretion. The provision of a refund in one instance does not entitle the user to a refund for similar instances in the future, nor does it obligate the Department to provide a refund in the future, under any circumstance.

6. Payment Methods. By providing a Payment Method for use by Auto-Renewal, the user authorizes the Department to make recurring charges to the Payment Method and, if necessary, to initiate adjustments for any transactions credited or debited in error. This authorization will remain in effect until the user cancels their Auto-Renewal membership as described in these terms and conditions (see Cancellation).

  1. Payment Method Updates. The user may update their Payment Method on file by visiting the Department’s Online Permit System website (https://www.mdc.mo.gov/buypermits) and selecting the “Manage Your Account” link.
  2. Payment Method Expiration. If the user’s Payment Method expires prior to, or at the time of renewal, an email will be sent to the user notifying them to update the Payment Method on file with their Auto-Renewal membership.
  3. Insufficient Funds/Failed Charge Attempts. If the user’s Payment Method is unable to successfully process the renewal transaction due to insufficient funds, the card is no longer valid, or there is another issue with the cardholder’s account, the transaction will be attempted a maximum of four (4) times. Following each failed attempt to process the transaction, an email will be sent to the user. If after four (4) attempts the charge is unsuccessful, the user’s Auto-Renewal account will be automatically inactivated and permits will not be renewed. An email notification will be sent to the user indicating their removal from Auto-Renewal and that permits enrolled have not been renewed. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check your Payment Method provider for details.
  4. Card Liability: The Department is not liable for the payment method information submitted by the user. Payment Method is tokenized and is securely maintained by a third-party contractor.

7. Cancellation. Users may cancel their Auto-Renewal membership at any time and the Payment Method will not be charged provided the cancellation is received at least five (5) business days before the renewal date identified in renewal communications. By cancelling the Auto-Renewal membership, the user will be required to purchase permits that were once enrolled.

  1. Cancellation Process. A user may cancel their enrollment in Auto-Renewal by using one of the following ways described below.
    1. Manage Your Account. User may cancel their Auto-Renewal membership by using the “Manage Your Account” feature located online at www.mdc.mo.gov/buypermits. The user will select “Manage Your Account,” log into their account, and then select the “Manage Your Auto-Renewal Settings.” To cancel the membership, the user will turn off all permits currently enrolled and select “Save.” Following the successful completion of editing the auto renewal settings, the user will receive a confirmation email that their permits and Payment Method have been removed from their account.
    2. Contact the Missouri Department of Conservation Headquarters. Users may request their Auto-Renewal membership be cancelled by contacting the Permit Services section located in the Department’s Headquarters in Jefferson City, MO. The section may be reached by calling (573) 522-0107 (option 4).
  2. Permits Issued Prior to Cancellation of Auto-Renewal. If the user cancels their Auto-Renewal membership, any permit(s) issued prior to the cancellation date will remain active and valid for use until the expiration date indicated on the permit has ended.

8. Electronic Delivery of Disclosures and Notices; Communication Preferences. The Department may be required by law to give the user certain information in writing, which means the user is entitled to receive it on paper. The Department may provide this information to the user electronically, instead, with prior consent. In addition, the Department can use electronic records and signatures in its relationship with the user.

  1. Consent to Electronic Communication. By enrolling in and using Auto-Renewal, the user consents to the electronic delivery of the disclosures, agreements, change notices, terms and conditions and any other documents or communications pertaining to Auto-Renewal and the items purchased from the Department via the Permit Auto-Renewal Service. Communications will involve sending e-mails to the users e-mail address provided during enrollment (e.g., payment authorizations, Payment Method updates, confirmation e-mails and other transactional information; terms and conditions, privacy statement or notices and any changes thereto; pre-payment disclosures, transaction receipts and confirmations; and customer service communications) and are part of the agreement. In addition, the user also agrees that the Department does not need to provide you with non-electronic copies of the Communications. The user agrees that any Communications that the Department sends to you electronically will satisfy any legal communication requirements, including that such Communications be in writing. In addition, by enrolling in and using Auto-Renewal, the user affirms that they have access to the hardware and software requirements identified below. If the user chooses not to consent to the electronic delivery of the Communications or you withdraw your consent, then they will be restricted from using Auto-Renewal. The user should maintain copies of electronic Communications by printing a paper copy or saving an electronic copy.
  2. Covered Communications. Covered communications may include, but are not limited to, disclosures and communications the Department provides to the user regarding its services, such as: (i) terms and conditions, privacy statement or notices and any changes thereto; (ii) pre-payment disclosures, transaction receipts and confirmations; and (iii) customer service communications (such as claims of error communications) ("Communications"). The user also consents to receiving certain other communications from Department, such as updates about new online permit system features and content, special offers, promotional announcements and customer surveys via e-mail or other methods.
  3. Methods of Providing Communications. The Department may provide Communications to the user by e-mail or by making them accessible on the Department online permit system website (www.mdc.mo.gov/buypermits), mobile applications, or mobile websites (including via "hyperlinks" provided online and in e-mails). Communications will be provided online and viewable using browser software or Portable Document Format (“PDF”) files.
  4. Hardware and Software Requirements. To receive and retain electronic Communications, the user must have the following:
    1. A valid e-mail address;
    2. A computer or device capable of accessing the Internet and capable of receiving, accessing, displaying, and either printing or storing Communications received in electronic form;
    3. Internet access;
    4. An Internet browser that can support 128-bit SSL encrypted communications, which requires a minimum web browser version of Microsoft® Internet Explorer version 6, and your system or device must have 128-bit SSL encryption software;
    5. Software that permits the user to receive and access PDF files, such as Adobe Acrobat Reader® version 8.0 and above; and
    6. Sufficient storage space to save Communications (whether presented online, in e-mails or PDF) or the ability to print Communications.

The ability to access to this page verifies that the users system/device meets these requirements and that the system/device has the necessary software to receive and access PDF files.

5. Withdrawal of Electronic Acceptance of Communications. A user may withdraw their consent to receive communications electronically by contacting the Department in writing via e-mail permits@mdc.mo.gov or by postal mail at "Missouri Department of Conservation, Attn: Permit Services Electronic Communications Withdrawal, PO BOX 180, Jefferson City, MO 65102.” The withdrawal of consent will cancel the user’s agreement to receive electronic communications, and therefore, the ability to use Auto-Renewal. Any withdrawal of a user’s consent to receive electronic statements will be effective only after the Department has a reasonable period of time to process the request.

6. Requesting Paper Copies of Electronic Communications. The user may request a paper copy of any communications provided electronically. The Department will mail the user a copy via U.S. Mail. To request a paper copy of a communication document, contact the Department in writing via e-mail at permits@mdc.mo.gov, or by postal mail at " Missouri Department of Conservation, Attn: Permit Services Electronic Communications Withdrawal), PO BOX 180, Jefferson City, MO 65102” A current mailing address is required to process this request. The Department may charge the user a nominal fee, as allowable by law, for this service.

7. Updating Your Contact Information. It is the user’s responsibility to ensure the email address provided for Auto-Renewal remains current for all Department communications sent electronically. The user understands and agrees that a Department communication is issued and it is not received because the user’s primary e-mail address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, the Department will be deemed to have provided the Communication to user; however, the Department may deem the user’s account inactive. The user may not use Auto-Renewal until a valid e-mail address has been provided. If the user has a spam filter or similar software that blocks or re-routes e-mails from senders not listed in the user’s e-mail address book, the Department recommends that the Department be added to the user’s approved contact’s list to ensure they receive of all Auto-Renewal communications. The user can update their primary e-mail address, and other pertinent information by using the Manage Your Account feature located on the Department’s online permit sales website (https://mdc.mo.gov/buypermits).

6. Permit Auto-Renewal Service.

1. The user must be at least 18 years of age, or the age of majority in their province, territory, country, or state to enroll in Auto-Renewal. Users under the age of 18 or applicable age of majority, may utilize Auto-Renewal only with the involvement of a parent or legal guardian subject to these terms and conditions.

2. The Department may update Permit Auto-Renewal Service, including permit price changes and offering additional permits that are eligible for enrollment in Auto-Renewal. In addition, the Department may periodically test various aspects of Auto-Renewal. The Department reserves the right to, and by using Auto-Renewal the user agrees that the Department may, include or exclude the user from these tests without notice. The Department reserves the right in its sole and absolute discretion to make changes from time-to-time and without notice in how it offers and operates Auto-Renewal.

3. The user agrees to use Auto-Renewal in accordance with all applicable laws, rules and regulations, and other restrictions.

4. The Department may terminate or restrict a user’s use of Auto-Renewal without compensation or notice if the user is, or if the Department suspects the user is (i) in violation of any of these terms and conditions, (ii) engaged in illegal or improper use of Auto-Renewal, (iii) ineligible due to suspension or revocation to obtain or maintain hunting, fishing or trapping permits or other privileges.

7. Passwords and Account Access

1. The user, or the user’s parent or legal guardian, is responsible for updating and maintaining the truth and accuracy of the information included on the user’s account, including their Auto-Renewal settings and payment method. The user, parent or legal guardian, should not reveal to others the payment method details (e.g., last four digits of the credit or debit card, cardholders name, etc.) associated with the user’s Auto-Renewal settings.

2. The user should be mindful of any communication requesting that the user submit credit card or other account information. Providing information in response to these types of communications can result in identity theft. A user should always access their Auto-Renewal account by going directly to the Department’s online permit website (https://mdc.mo.gov/buypermits), and not through a hyperlink in an e-mail or any other electronic communication, even if it looks official. The Department reserves the right to place any account or Auto-Renewal membership on hold at any time with or without notification to the member to protect itself, the online permit system, and the Permit Auto-Renewal Service from what it believes to be fraudulent activity. The Department is not obligated to provide a credit or discount for holds placed on an account or membership by either a representative of the Department.

8. Disclaimers of Warranties and Limitation of Liability.

1. THE DEPARTMENT LICENSE SYSTEM, THE PERMIT AUTO-RENEWAL SERVICE, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE DEPARTMENT ONLINE PERMIT SYSTEM AND THE PERMIT AUTO-RENEWAL SERVICE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OR ANY KIND. THE DEPARTMENT DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT THE USER’S USE OF THE DEPARTMENT ONLINE PERMIT SYSTEM AND THE PERMIT AUTO-RENEWAL SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. THE DEPARTMENT SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF DEPARTMENT APPLICATIONS AND SOFTWARE.

2. TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL THE DEPARTMENT OR ITS COMMISSIONERS, DIRECTOR, EMPLOYEES, OR AGENTS BE LIABLE (JOINTLY OR SEVERALLY) TO THE USER FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RELATED TO YOUR USE OF THE DEPARTMENT ONLINE PERMIT SYSTEM OR THE PERMIT AUTO-RENEWAL SERVICE.

3. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

4. NOTHING IN THESE TERMS AND CONDITIONS SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. If any provision or provisions of these terms and conditions shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

9. Governing Law. Any and all disputes related to the online permit system, the Permit Auto-Renewal Service, or these terms and conditions shall be governed by the laws of the State of Missouri applicable to contracts entered into and performed entirely within the State of Missouri without reference to principles of conflict of laws. With respect to any claim for monetary damages against the Department, the appropriate venue shall be in the Cole County Circuit Court, Jefferson City, Missouri.

11. Survival. If any provision or provisions of these Permit Auto-Renewal Service Terms and Conditions shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
